Reference legislation for the CIN

The Ministry of Tourism has created the national database for vacation rentals (BDSR – Banca Dati delle Strutture Ricettive) for the purposes of assigning the CIN. CIN means Codice Identificativo Nazionale that is National Identification Code for vacation rentals.

The BDSR is a tool that implements, through interoperability mechanisms, information coordination between the State and local administration data and is aimed to provide a map of accommodation properties on a national scale, also useful for fight irregular forms of hospitality. By hospitality properties we also mean properties rented to tourists, yes.

In Puglia there is already a Structure Identification Code – CIS. With the new CIN, the CIS will disappear and only the CIN will remain operational.

We have seen the legislative framework, now let’s move on to operations.

How to get the CIN

Those of you who have already applied for the regional CIS in the past are already accustomed to the process of obtaining the code. In essence, little changes: the CIN vacation rentals is obtained electronically. Here is the complete procedure.

– Go to the BDSR online portal of the Ministry of Tourism (Accommodation Structures Database)

– Click on “Ottieni CIN”

– To enter the portal you will need to have your SPID access with you.

– If you already have the CIS of the Puglia Region, you will already find your property data pre-filled as the online platforms of the Puglia Region and the Ministry of Tourism communicate with each other. I suggest you to check your data are correct, just to be sure. The information contained in the database concerns, among other things:

  • type of accommodation
  • location
  • accommodation sleeps
  • person carrying out the hospitality business
  • regional code, where adopted, or unique alphanumeric code.

– In the CIN request procedure, however, there is an important innovation compared to the old CIS: you must make two declarations.

 

 

FIRST. At this point you must click on YES: all properties rented for tourist use MUST have a fire extinguisher as previously mentioned.

SECOND. The property is equipped with functioning devices for the detection of combustible gases and carbon monoxide.

In this case there is a note: if the property is not equipped with a gas system and the risk of uncontrolled releases of combustible gases or carbon monoxide formation is certainly excluded, you can click “NON APPLICABILE”. Therefore: if there is the possibility of gas leaks in the house you must have the safety device, otherwise not.

Once the procedure is completed, the BDSR system issues the CIN immediately, sending you an email with a summary PDF which also indicates the alphanumeric code. You can consult and download your CIN at any time by returning to the Ministry of Tourism platform always with your SPID.

What to do with the CIN

– The CIN must be published in all advertisements on OTA portals (such as Airbnb, Booking.com, …) and on any site where the property is promoted. Without it the listing is removed.
– The CIN must be displayed outside the building to which it refers.

On this point, while the regional CIS produced a ready-to-print label, the CIN does not. Therefore, I believe that the outdoor print can be customized to your liking (if you have any different news about it, write it in the comments).

Who must do the CIN

These obligations concern not only short-term rentals (within 30 days) pursuant to art. 4 of Legislative Decree 50/2017 but also all residential rentals beyond 30 days for tourist purposes, therefore excluding contracts of a transitory nature which are, as is known, stipulated for other reasons and/or purposes other than tourism (study, work, … ..).

CIN timelines

60 days are granted from the notice published in the Official Gazette n. 103 of 3 September 2024, or at the latest by 2 November 2024, to comply with the provisions of the decree-law relating to the obligations related to the CIN.

EXTENSION: the CIN comes into force on 01/01/2025.

What are the sanctions for failure to comply with the rules

– If the property is advertised or the property is rented without the CIN duly obtained, there are financial sanctions with amounts ranging from €800.00 to €8000.00.
– Failure to display the CIN outside the property or in all online advertisements, on portals or websites, may result in fines between €500.00 and €5000.00.
